Most NRIs who ask us about Jaipur property are told "yes, you can buy" and left to find the exceptions themselves. The exception that matters most is land: flats, villas and commercial units are open to you, while agricultural land and farmhouses are not.
What an NRI or OCI Can Buy
Under FEMA, a non-resident Indian or an Overseas Citizen of India can acquire residential and commercial immovable property in India without prior RBI approval. In Jaipur that covers apartments, independent houses and villas, plots in approved residential or commercial layouts, and shops or offices. There is no cap on how many such properties you can hold.
| Property type | NRI / OCI purchase | What to check |
|---|---|---|
| Apartment or studio | Allowed | Project registered with Rajasthan RERA; possession date; escrow |
| Independent house or villa | Allowed | Title chain, approved map, occupancy certificate |
| Plot in an approved layout | Allowed | JDA approval or approved colony; land use; conversion papers |
| Commercial shop or office | Allowed | Approved commercial use; completion certificate |
| Agricultural land | Not allowed | Inheritance or gift is a separate route |
| Farmhouse or plantation property | Not allowed | Many "farmhouse plots" sit on agricultural land |
The Farmhouse Trap
Jaipur has a lively market in "farmhouse plots" and farm-style projects. If the land is recorded as agricultural, an NRI cannot buy it directly, however the brochure describes it. Before you pay a token amount, ask for the land-use record and any conversion order, and read our guides on how to check land use and agricultural versus residential land. A resident family member buying in their own name is a different arrangement with its own legal and tax consequences, so take advice instead of improvising.
Not sure if a property qualifies?
Send us the project name or the khasra details. Our NRI desk checks the land classification and RERA record before you spend time on it.
How an NRI Pays
- Inward remittance from your overseas account to an Indian bank account in your name.
- Funds from your NRE, NRO or FCNR(B) account in India.
- Home loan from an Indian lender. Rules and documents are in our home loan guide.
- Never cash, and never a third party paying on your behalf without a paper trail. Banks ask for the source of funds when you later sell and repatriate.
Documents You Will Need
Expect to provide a passport copy, overseas address proof, PAN, a visa or OCI card, and your NRE/NRO account details. If you cannot travel, a registered power of attorney lets a trusted person handle site visits, verification and registration. Our buyer's legal checklist lists the title and approval documents to verify for any buyer.
Check RERA and Approvals Before You Pay
For any under-construction project, confirm the registration number, approved plans, completion date and escrow detail on the Rajasthan RERA portal. For plots, see JDA-approved plot versus colony for what approval actually means.
