Dubai's sales pitch is simple: no income tax on rent, no capital gains tax. For an Indian buyer that is only half the picture. India taxes residents on their worldwide income and expects disclosure of foreign assets, so the rules on the Indian side matter as much as the Dubai fees.
Residents and NRIs Are Treated Differently
| Resident Indian | NRI | |
|---|---|---|
| Funding route | Remit from India under LRS | Use foreign income or funds already abroad; NRE balances can go abroad within the rules |
| Remittance limit | USD 250,000 per person per financial year under LRS | No LRS limit on funds that are already outside India |
| TCS on remittance | Yes, above the threshold | Not on funds sent from abroad |
| Foreign asset disclosure in India | Schedule FA in your return | Generally not for assets abroad while non-resident |
| Tax on Dubai rent | India taxes worldwide income; UAE has no personal income tax | Generally taxed in the country of residence, not India |
The LRS Route for Residents
Under RBI's Liberalised Remittance Scheme an adult resident can remit up to USD 250,000 a year for permitted purposes, including buying property abroad. Larger purchases are often spread across family members' limits or across financial years, but each person's remittance has to be their own funds with a clear source. Your bank collects a declaration and applies TCS.
TCS: A Credit, Not a Final Cost
Tax Collected at Source on LRS remittances for overseas property and investment has been 20% on the amount above Rs 10 lakh in a financial year, and the 2026 Budget changes we found were on education, medical and tour packages, not on this category. TCS is not an extra tax: it is credited against your income tax and refundable if it exceeds your liability, but it blocks cash until you claim it. Confirm the current rate and threshold with your bank when you remit.

Disclosure: Do Not Skip Schedule FA
A resident Indian owning property in Dubai must declare it in the foreign assets schedule of the income tax return, every year, with the acquisition details. Failing to disclose a foreign asset can invite a penalty under the Black Money Act; reports put it at up to Rs 10 lakh per year. Hold the purchase contract, payment proofs, title deed and service charge statements together for your CA.
Rent and Resale
- Rent: the UAE does not charge personal income tax on an individual's rental income. A resident Indian owner generally reports it in India and may claim credit for any foreign tax. The India-UAE tax treaty helps prevent double taxation.
- Sale: Dubai has no capital gains tax on individuals, but India taxes a resident on the gain, and the remittance of sale proceeds back to India has to be documented.
- Currency: the dirham is pegged to the US dollar, so a weaker rupee raises your cost and can raise your rupee return on exit. Model both in our currency converter.
