A Power of Attorney is how most NRIs complete a Jaipur purchase or sale without flying in. It is also the document most often drafted badly. A vague POA signed in a hurry can give someone far more authority than you intended.

Special or General POA

A special POA authorises named acts for one transaction: for example, to inspect a flat, pay instalments to the builder's escrow account, and sign and register the sale deed for a described unit. A general POA covers a broad class of acts. For a property deal, choose the special form, identify the property by survey, plot or RERA details instead of "my property in India", and write in a clear end point such as completion of registration.

Execution Abroad, Step by Step

  1. Have the POA drafted or reviewed by an Indian lawyer who knows Rajasthan registration practice, before you sign.
  2. Sign in front of a notary in your country of residence, with witnesses present. Do not pre-sign.
  3. Authenticate it. If your country is a Hague Apostille Convention member, get the Apostille from its designated authority. Otherwise, or if the Indian side insists, get it attested by the Indian embassy or consulate. Confirm which route applies to your country.
  4. Courier the original to your attorney in India and keep the tracking record. The clock for stamping starts when the document arrives in India.
  5. Get it stamped and registered in India (below).

Stamping and Registration in India

A document executed outside India is generally to be stamped within three months of its first receipt in India. Stamp duty is a state subject, so the amount depends on the Rajasthan schedule and the type of POA, and it is often higher for an attorney who is not a family member. Check the current duty with the sub-registrar or an advocate instead of relying on an old figure. A POA that deals with immovable property, or that authorises the attorney to present documents for registration, should be registered at the sub-registrar's office with jurisdiction over the property. Late stamping can make the document inadmissible or attract a penalty.

Who to Appoint

  • Choose someone you trust personally, ideally a close family member who lives in Jaipur. Do not give a POA to a broker or a salesperson of the seller.
  • Set limits in writing: a minimum price for a sale, named bank accounts for money, and a bar on sub-delegation.
  • Keep control of the money. Payments should go from your own account to the developer's RERA escrow account or the seller's verified account, not through the attorney's pocket.

What a POA Cannot Do

It cannot be used to transfer property to the attorney. It does not remove the need for the seller's title to be clean. It generally lapses if the principal dies, so plan for inheritance separately. And you can revoke it, but a revocation must reach the sub-registrar and anyone relying on the POA to be effective in practice. See our legal checklist for the title documents to verify before any money moves.
